Acceptance of Terms

By accessing or using the Main Street Mail service ("Service") operated by Friendly City Custom Printing ("FCCP," "we," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including customers who create projects, their guests who submit addresses, and any staff accessing the administrative dashboard.

Description of Service

Main Street Mail is an address-collection and mail-merge service. We handle the post office side of your event so you do not have to.

Customers place print orders with FCCP for mail-merge products (envelopes, invitations, holiday cards, etc.). FCCP creates a project for that order and provides a branded link. Guests fill out a form with their address. The customer reviews and approves the collected addresses, and FCCP produces a print-ready mail-merge file.

FCCP creates all projects. Customers cannot self-serve project creation.

Guest Submissions

When a guest submits their address through a collection form, they are providing their information to the customer who shared the link and to FCCP as the service provider. Guests represent that the information they submit is accurate and belongs to them.

Guests should not submit addresses for others without their consent. By submitting an address, the guest consents to its use for the event they were invited to, per the Privacy Policy.

Customer Responsibilities

As a customer of FCCP using the Main Street Mail service, you:

  • Warrant that you have the right to invite the guests you invite and to process their personal information for the intended purpose
  • Are the data controller for addresses you collect; FCCP is the processor
  • Indemnify FCCP against any claims arising from misuse of guest data you collect through the Service
  • Agree not to use the Service for any illegal purpose or in violation of any applicable law
  • Agree not to send unsolicited communications (spam) to guests through the Service
  • Agree not to use the Service to collect addresses for purposes unrelated to your print order with FCCP

Acceptable Use

You may not use the Service to:

  • Collect addresses without a legitimate, corresponding print order with FCCP
  • Send unsolicited mail or communications to guests
  • Harass, defame, or cause harm to any person
  • Violate any applicable law, including anti-spam regulations (CAN-SPAM, CASL, GDPR)
  • Attempt to gain unauthorized access to any part of the Service
  • Upload or transmit any malicious code, viruses, or harmful content
  • Resell or redistribute the Service without FCCP's written consent

FCCP reserves the right to suspend or terminate access to the Service for customers who violate these Terms, after written notice and a reasonable opportunity to cure.

Intellectual Property

The Main Street Mail service name, branding, and associated intellectual property are owned by FCCP. Customers do not acquire any ownership rights to the Service or its branding by using it.

FCCP templates (designs, layouts, formatting rules) are proprietary. Customers may not copy, reproduce, or reverse-engineer FCCP's templates or proprietary formatting logic.

Customers retain ownership of their master contact lists and any custom content they provide.

Data Ownership and Retention

Customers own their master contact lists. FCCP retains the right to use anonymized, aggregate data about Service usage for operational improvement purposes only.

Data retention is governed by the Privacy Policy. Inactive customer accounts (no login for 24 months) will be archived and then deleted per the retention schedule described there.

Service Limitations and Disclaimer

Address validation is provided as a best-effort service. FCCP does not guarantee 100% deliverability of mail pieces, as address accuracy depends on USPS data accuracy, carrier handling, and other factors outside our control.

Reprint policy: If address validation passes and FCCP signs off on an export, any reprints required due to address errors are FCCP's responsibility. If a customer skips validation or overrides validation flags and a reprint is needed, the cost of that reprint is the customer's responsibility.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FCCP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FCCP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER FCCP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FCCP's total liability for any claim arising out of or related to the Service shall not exceed the amount paid by the customer for the specific order giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless FCCP and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms
  • Your misuse of the Service
  • Any claim that the data you collected violates the rights of a third party
  • Your violation of any applicable law or regulation

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify customers via email and update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of [STATE], without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in [STATE].
